The Town has received a development application for Grouped Dwelling(s) or Single House- Residential. The application proposes {­can add a sentence or two to describe the proposal to the public}

In accordance with Local Planning Policy 37 – “Community Consultation on Planning Proposals”, you are invited to comment on the following matters:

  • ROW Setback – Council’s Local Planning Policy – Streetscape requires a minimum setback of 7m metres from any upper floor of a two storey development to the centreline of the right-of-way. The application proposes a 5.6 metre minimum setback from the upper floor to the centreline of the right-of-way.


  • Maximum Height of Boundary Wall – A boundary wall to the common boundary with No 40 Mint Street has a maximum height of 5.7 metres above natural ground level in lieu of a maximum height of 3.5 metres as permitted under Council’s Local Planning Policy – Boundary Walls. Over height boundary walls are permitted where they abut an existing or simultaneously proposed boundary wall. In this instance, however, a similar boundary wall proposed at No. 42 Mint Street sits 1.5m further back from the right-of-way, meaning that a 1.5m long portion of the two-storey high boundary wall proposed for No 42 will be visible from the right-of-way. This portion of the wall is the non-compliant portion.


  • Visual Privacy – The Residential Design Codes prescribes minimum setback distances for unscreened major openings from boundaries in order to achieve a reasonable level of privacy. The application proposes variations as follows
      • Bedroom 3 window to south western boundary – 4.5 metres required; 3.1 metres proposed.
