Under section 3.16(2 & 2a) of the Local Government Act 1995, Local Government Authorities are required to review their Local Laws every eight years.

The Town of Victoria Park proposes to review its Dog Local Law to determine whether or not it should be repealed or amended.

What is happening now?

A review was undertaken of the current Town of Victoria Park Dog Local Law. Significant operational amendments were made pursuant to changes to the Dog Act1976, requiring the adoption of a new Dog Local Law. At it's Ordinary Council Meeting in October 2018, Council adopted the new Dog Local Law 2018.

    The Proposed amendments to the current Dog Local Law, are as follows:

    Part 1 - Preliminary

    1. An additional clause (1.2 Commencement) has been added. This clause is necessary to advise when the Dog Local Law 2018, comes into operation.

    Part 3 – Requirements and limitations on the keeping of dogs

    1. An additional clause (3.2 Notice to occupier) has been added. This clause is necessary to advise dog owners, their fences are not adequate to confine their dog/s and what specific measures are required to address the non-compliance.

    Part 4 – Approved Kennel Establishments

    1. The entire section has been removed. The Town of Victoria Park would not be able to approve a Kennel Establishment. The Town is too built up to accommodate a Kennel Establishment.

    2. Subsequently, Schedule 1 - Application for a licence for an approved kennel establishment & Schedule 2 - Conditions of a licence for an approved kennel establishment, have been removed.

    3. Part 4 in the proposed Dog Local Law 2018 will be ‘Dogs in a Public Place’.

    1. Clause 4.2 in the proposed Dog Local Law 2018, (Places which are dog exercise areas) is now Schedule one.

    Part – 5 Dogs in Public Place

    1. Has changed to Miscellaneous in the proposed Dog Local Law 2018.

    Part - 6 Miscellaneous

    1. Has changed to Enforcement in the proposed Dog Local Law 2018.

    Part – 7 Enforcement

    1. There is no part seven in the proposed Dog Local Law 2018.

    Schedule 2

    1. Schedule two, is now Modified Penalties in the proposed Dog Local Law 2018.
