The Town has received a development application for a grouped dwelling.

In accordance with Local Planning Policy – “Community Consultation on Planning Proposals”, you are invited to comment on the following matters:

  • Boundary Setbacks – The Residential Design Codes prescribes the minimum setback distance of buildings from boundaries other than the street. The application proposes variations to the setback of the following walls:
    • Upper Floor wall to Bedroom 2 to Balcony wall of proposed dwelling - 2.2 metres required; 1.5 metres proposed to north eastern boundary.
  • Visual Privacy – The Residential Design Codes prescribes minimum setback distances for unscreened major openings* from boundaries in order to achieve a reasonable level of privacy. The application proposes variations as follows:
    • Sitting room/stairwell void window of proposed dwelling to north western boundary – 6 metres required; 2.5 metres** proposed.

*Note: This window is only treated as a ‘Major Opening’ for the purposes of assessing visual privacy under clause 5.4.1 of the R-Codes. Given this window is to a stairwell (this being a categorised as a non-habitable room) it has been treated as a ‘Minor Opening’ for the purposes of establishing the deemed-to-comply boundary setbacks under clause 5.1.3.

**Distance measured is from balustrade of sitting room area, this being the closest adjacent habitable space with (potential) line of sight.
