The Town has received a development application for Two (2) Grouped Dwellings at the property as mentioned above.

In accordance with Local Planning Policy 37 – “Community Consultation on Planning Proposals”, you are invited to comment on the following matters:

Fill and Retaining behind Street Setback Line - A retaining wall and associated fill is proposed to be constructed along the following boundaries:

  • South eastern side boundary in common with 21 and 21 A Devenish Street. The retaining wall and fill is proposed with a maximum height of approximately 770mm above natural ground level.
  • South western rear to the boundary in common with 1A and 1B Hertford Street. The retaining wall and fill is proposed with a maximum height of approximately 1.1 metre above natural ground level.
  • South eastern side to the boundary in common with 29 Devenish Street. The retaining wall and fill is proposed with a maximum height of approximately 970mm metres above natural ground level.

The Residential Design Codes permit filling and associated retaining walls behind the street setback line and within 1.0 metre of a common boundary up to a maximum height of 500mm above natural ground level.

Visual Privacy – The Residential Design Codes prescribes minimum setback distances for unscreened major openings (large windows) from boundaries in order to achieve a reasonable level of privacy. The application proposes variations as follows:


  • Unit 4 - Ground Floor unscreened major opening to the Kitchen with finished floor level raised more than 500mm from natural ground level to the north western boundary in common with 21 and 21 A Devenish Street – 6 metre setback required; approximately 5.255 metres setback proposed.
  • Unit 4 - Ground Floor unscreened major opening to the Dining Room with finished floor level raised more than 500mm from natural ground level to the north western boundary in common with 21 and 21 A Devenish Street – 6 metre setback required; approximately 3.3 metres setback proposed.
