Consultation has concluded

In 2018, Council received a development application for a Change of Use to Educational Establishment (Green Space for Recreation and Other Purposes) and works including Landscaping, Fencing & Retaining Walls at the above-mentioned property.

This development application was the subject of community consultation in June-July of 2018 and was deemed refused. This deemed refusal is the subject of an appeal by the applicant to the State Administrative Tribunal (SAT). Through SAT mediation, the applicant has prepared a revised proposal with additional supporting information. This revised proposal is now the subject of further community consultation.

In accordance with Local Planning Policy 37 – “Community Consultation on Planning Proposals”, you are invited to comment on the following matters:

  • Proposed Use – The proposed use of the site is classified as being ‘Educational Establishment’ under Town Planning Scheme No. 1, which is an “AA” (discretionary use) within the Residential zone. The proposal is effectively an extension to Ursula Frayne Catholic College, the existing Educational Establishment at No. 15 Duncan Street.
  • Proposed works – The proposed works on-site include landscaping, fencing, seating and a shelter structure.

Who will decide this application?

At the time of this consultation page being written, current SAT orders direct Council to reconsider its decision at the Ordinary Council Meeting (OCM) to be held on 21 May 2019. This matter is therefore likely to be discussed at the Elected Members Briefing Session (EMBS) held on 7 May 2019. The meetings will commence at 6:30pm and will be held in the Council Chambers on the first floor of Council’s Administration Centre located at 99 Shepperton Road, Victoria Park. To this extent, the decision-maker for this development application is the Town of Victoria Park.

It is noted that, should the applicant be dissatisfied with the decision made at the above-mentioned Ordinary Council Meeting, they will have the option to take their appeal to a full hearing at the State Administrative Tribunal. Should this occur, the Town of Victoria Park will not be the decision-maker
