Consultation has concluded

The Town has received a development application for a Patio.

In accordance with Local Planning Policy 37 – “Community Consultation on Planning Proposals”, you are invited to comment on the following matters:

  • Maximum Height of Boundary Wall – A boundary wall to the southern boundary with a maximum height of 3.6 metres above natural ground level in lieu of a maximum height of 3.5 metres as permitted under Council’s Local Planning Policy – Boundary Walls.
  • Length of Boundary Wall – A boundary wall to the southern boundary is proposed to have a length of 26.8 metres. In lieu of a maximum lot boundary length of 9 metres as permitted under Council’s Local Planning Policy – Boundary Walls.

Please note that the ‘boundary wall’ referred to above is not a solid brick wall or similar in this instance, and is actually a series of posts for the existing garage and proposed patio roof that is considered to form an effective ‘wall’ the purposes of determining side boundary setbacks. Given that the standard setback requirement for a wall longer than 9m in length is 1.5m and the proposed ‘wall’ is located within this setback area (940mm off the boundary), the series of posts described above is (under the applicable policy definitions) considered to form a ‘lot boundary wall’.

If (hypothetically) the proposed development was not considered to form a ‘lot boundary wall’, then the proposed structure’s height and length would be deemed-to-comply, but the side boundary setback of 940mm from the southern lot boundary would be a variation from the 1.5m deemed-to-comply setback requirement.
