With endorsement by the Council on 20 of August 2019, the Town is commencing a formal public submission period for the proposed sale of 355-357 Shepperton Road, East Victoria Park.

The proposed land sale is part of the Land Asset Optimisation Strategy (LAOS). LAOS is a priority project for the Town of Victoria Park that will aim to deliver revenue diversification and generation. It will also enable redevelopment proposals and act as a catalyst for regeneration or redevelopment of the Town's land assets.

Strategically LAOS will help reduce the Town's reliance on rates and aim to achieve greater financial resilience.

At it's Ordinary Council Meeting in November 2019, Council resolved to approve the contract of sale 355-357 Shepperton Road for the value of $3,821,000.00.

  • Your response to my last question "Can you confirm that this property was looked at by the LAOS project team and that a full assessment was carried out or was it just listed as one of the properties in the Town with no evaluation conducted at the time the LAOS was produced? Will you please provide the recommendation of the project team in relation to this property if in fact an assessment was carried out? " was to send me the motion that the Council approved last month. This is not the recommendation from the LAOS project team. Will you please provide the recommendation of the LAOS Project Team as contained in the 2013 Hester LAOS document. ? How does Council expect the public to put forward submissions on the sale of land when most of the details are being withheld?

    The 2013 Hester Land Asset Optimisation Strategy report is a confidential item and therefore Officer recommendations listed within this report are also confidential. 

    I can confirm that this property was included within identified LAOS opportunities.

  • Will the report presented to the Council on submissions received on the proposed sale of the land be included in the agenda for the Council meeting or will it be a confidential report and discussed behind closed doors? The Council resolution of 20 August 2019 refers to imposing special conditions on the sales contract to sell the land. What legal mechanism will be used to guarantee that these conditions are adhered to and enforceable by the Town on the proposed purchaser and any subsequent purchaser/owner of the land when the land is developed?

    Hi Christopher. The report to Council will include public submissions received during the advertising period. At this stage the report will not be a confidential item. Annexures within the contract of sale will be the legal mechanism to enforce required conditions on the purchaser.

  • As a Councillor I was shown a copy of the confidential LAOS report however I do not recall this carpark as being one of the dozen or so properties in East Vic Park that were considered in the report as suitable for sale/redevelopment. Can you confirm that this property was looked at by the LAOS project team and that a full assessment was carried out or was it just listed as one of the properties in the Town with no evaluation conducted at the time the LAOS was produced? Will you please provide the recommendation of the project team in relation to this property if in fact an assessment was carried out? These recommendations were of a high level and did not contain any commercially sensitive information and there is no reason for the Town to withhold this information from the Ratepayers under the pretext that it is commercially sensitive.

    Hi Vince. Thanks for your question.

    I can confirm that this property was included within identified LAOS opportunities. The unsolicited bid was assessed initially and a business case developed. This information was presented to Council as a report with a recommendation that was endorsed. The recommendation from the report is provided below:


  • Is the report demonstrating due diligence undertaken on the offer by Town staff and including independent consultants and certified valuers publicly available information? Is the business case that was presented to Council publicly available information?

    Hi Christopher. The Business Case and report prepared for Council consideration was confidential as the Town needs to ensure that we have a strong negotiation position with the proponent. This position could be undermined if the proponent has access to our business case and Council report. By ensuring the deliberations remain confidential during negotiations we are able to get the best result for ratepayers. Contract negations with the proponent are still being undertaken. 

  • Good evening Can you please confirm that this property 355-357 Albany Highway is included in the LAOS document prepared for the Town by Hester Property Solutions in 2013? If it is not in the 2013 LAOS document can you please advise the date and circumstances with which this property became included in the Towns Land Asset Optimisation Strategy?     Hi Joe,

    Although the design is not finalised, at this stage a small neighbourhood shopping centre inclusive of a supermarket and associated speciality retail along with commercial/office space on level one has been proposed.

  • Is the Land Asset Optimisation Strategy (LAOS) a public document as it does not seem to be on the Council website? Is there any publicly available information on the report or information presented to Council on this proposed land sale as there is nothing in the agenda or minutes of the Council Meeting on 20 August as it was dealt with as a confidential item? Why was this item dealt with by Council behind closed doors, when there appears to be no commercially confidential issues and the details of the purchaser and the purchase price are public information??

    The Land Asset Optimisation Strategy was received as a confidential item to Council as it contains financially sensitive information that may undermine the ability of the Town to achieve the best result for ratepayers. 

    The report on 355-357 Shepperton Road was confidential for similar reasons - as it contained commercial considerations and a strategy for negotiations with the proponent which would be undermined if the proponent had access to this information. The Town is currently undertaking those negotiations.
