Request for Scheme Amendment to rezone 176 Swansea Street

The Town of Victoria Park has received a request from the property owners of lots 20 and 21 at 176 Swansea Street, East Victoria Park (Swansea Street Markets site) to support a Scheme Amendment to rezone the site from a zoning of ‘Industrial (1)’ to a zoning of ‘Commercial (R-AC3)’. Prior to Council considering the request, public comments are being sought.

The proposed rezoning is intended to facilitate the redevelopment of the Swansea Street Markets site as a mixed use development incorporating commercial and residential uses.


If rezoned ‘Commercial (R-AC3)’, development provisions that would apply to the land would include (but not be limited to):

  • Land use – acceptable uses of the land will be as outlined in the zoning table of Town Planning Scheme No. 1 for land zoned ‘Commercial’. This could include a range of different commercial uses, retail and/or residential.
  • Building height – maximum 6 storeys;
  • Plot ratio – maximum of 2.0;

In support of the request to rezone the site, concept plans have been prepared illustrating the possible redevelopment of the site should the rezoning to ‘Commercial (R-AC3)’ be approved. Notable aspects of the concept plans include :

  • Three buildings across the site, with each building potentially being up to 6 levels.
  • Two of the buildings being for residential use.
  • One of the buildings containing commercial uses at ground level, with residential units above.
  • The proposed commercial use is said to be for the continuation of the Swansea Street markets on the site.
  • The redevelopment of the site being staged so that the markets continue to operate throughout.

While the concept plans are a useful reference and indication of the possible form of development should the rezoning to ‘Commercial (R-AC3)’ be approved, it should be noted that the plans are just concept plans and the landowner is not required to develop the land in the manner illustrated in the concept plans. The landowner may ultimately choose to redevelop the land in a different way.

Therefore in considering and commenting on the matter, it is recommended that you focus your comments on the acceptability of the rezoning to ‘Commercial (R-AC3)’ and the associated development provisions that would apply, rather than provide comments on the concept plans.

Next steps

Following closure of the consultation period, all submissions received will be considered by the Town’s Urban Planning Unit before a report is presented to a Council meeting for a decision. Everyone who provides feedback will receive notice inviting them to attend the meeting.

If Council agrees to commence the process of rezoning the land, there is a formal statutory process to be followed. This will include further community consultation, and ultimately the Minister for Planning deciding whether or not to approve the rezoning.
