Amendment No. 91 to Town Planning Scheme No. 1 - Additional Use of Tavern at No. 98-106 Goodwood Parade, Burswood
In April this year, the Town sought preliminary comments on a request to amend Town Planning Scheme No. 1 (TPS 1) to allow the use 98-106 Goodwood Parade, Burswood as a Tavern. Council considered the public submissions received and resolved at the May 2022 Ordinary Council Meeting to initiate Amendment No. 91 to TPS 1 for the above purpose.
As per the Planning and Development (Local Planning Schemes) Regulations 2015, a formal statutory consultation period applies, and your comments are sought.
Proposal
The subject sites are identified in the image below.
Under TPS 1, a ‘Tavern’ is currently an ‘X’ (prohibited) use of the land. It is proposed to amend Schedule C of TPS 1 by listing a ‘Tavern’ as an Additional Use with an ‘AA’ (discretionary) land use permissibility on the sites.
TPS 1 defines a ‘Tavern’ as “premises the subject of a tavern licence granted under the Liquor Control Act 1988.” A Tavern Liquor Licence authorises the sale and supply of liquor for consumption on and off the licensed premises.
As you may be aware, the Town has also concurrently received a development application for a change of use of the same sites to ‘Restaurant/Café and ‘Brewery’ and associated physical works for the existing buildings on the subject site. These uses are capable of being approved under TPS 1 and the development application was considered at the Ordinary Council Meeting on 16 August 2022

This proposed Amendment is available for inspection and public comment, and it should not be construed that final approval will be granted.
