Request for Amendment to Town Planning Scheme No.1 to Permit a Tavern at No. 98-106 Goodwood Parade, Burswood

The Town has received a request to amend Town Planning Scheme No. 1 (TPS 1) to allow a ‘Tavern’ land use at No. 98-106 (Lots 1-5) Goodwood Parade, Burswood. Under TPS 1, a ‘Tavern’ is currently an ‘X’ (prohibited) use of the land. It is requested that Council agree to amend Schedule C of TPS 1 by listing a ‘Tavern’ as an Additional Use on the subject site, which would then permit a ‘Tavern’ land use on the site.

TPS 1 defines a ‘Tavern’ as “premises the subject of a tavern licence granted under the Liquor Control Act 1988.” A Tavern Liquor Licence authorises the sale and supply of liquor for consumption on and off the licensed premises.

The subject sites are identified in the image below.

In addition to the request to amend TPS 1 it should be noted that the Town has also concurrently received a development application for a change of use of the same sites to ‘Restaurant/Café and ‘Brewery’ and associated physical works for the existing buildings on the subject site. These uses are capable of being approved under TPS 1. Comments are not being sought on this application at this time. This will be the subject of separate community consultation in the near future.

In accordance with Local Planning Policy 37 “Community Consultation”, prior to Council formally considering whether or not to support the request to amend TPS 1 to permit a ‘Tavern’ on the land, you are invited to provide comment.

Next steps

Following closure of the consultation period, all submissions received will be considered by the Town’s Urban Planning Unit before a report is presented to a Council meeting for a decision. Everyone who provides feedback will receive notice inviting them to attend the meeting.

If Council agrees to proceed with the scheme amendment, there is a formal statutory process to be followed. This will include further community consultation, and ultimately the Minister for Planning deciding whether or not to approve the proposal.
