Draft Local Planning Scheme No. 2

The Town has prepared a new Local Planning Scheme No.2. The new Scheme proposes to update the Town’s local planning framework of zones, densities and planning controls such as heights, plot ratio and land use permissibility.

The new Scheme will guide the assessment of development and subdivision applications and will replace Town Planning Scheme No.1.

The Scheme is based on the recommendations of the Town’s Local Planning Strategy (May 2022) and the requirements of the State Government’s statutory and strategic planning framework.

The new Scheme applies to the whole of the Town, except for the Casino (Burswood Island) Agreement Act 1985 land over part of Burswood Peninsula.

The format of the Scheme and the process for preparing and approving the Scheme must comply with the Planning and Development Act 2005 and the Planning and Development (Local Planning Scheme) Regulations 2015.

At the 16 August 2022 Ordinary Council meeting, the Council resolved to endorse the draft Local Planning Scheme No.2 for advertising. A copy of the Council report and draft Scheme is in the Key Documents folder to the right of this page.

The Town has submitted the draft Scheme to the Department for Planning, Lands and Heritage who have requested several changes to the draft Scheme for consideration of the WA Planning Commission who will grant permission for advertising.

The draft Scheme was submitted to the Environmental Protection Authority (EPA) and no advice regarding environmental assessment (section 48A of the Environmental Protection Act) has been received.

The Town anticipates commencing advertising in the first half of 2023 for a minimum of 90 days (excluding public holidays).
