Amendment to Town Planning Scheme No. 1 - Additional Use (Restaurant/Cafe) for No 53 & 55 Canning Highway, Victoria Park

Council has received a request to amend the Town of Victoria Park Town Planning Scheme No. 1 for the purpose of:

  • Amending ‘Schedule C – Additional Uses’ by inserting the use of ‘Restaurant/Café‘ as a discretionary use on No. 53 and 55 (Lots 31, 32 and 33) Canning Highway, Victoria Park.

The applicant has advised that the intent of this amendment relates to facilitating a ground floor Café to the ground floor “Communal Lounge” depicted in the Development Application for 23 Multiple Dwellings that was approved by the Metro Central Joint Development Assessment Panel (JDAP) in August 2019. Council has received a request to amend the Town of Victoria Park Town Planning Scheme No. 1 for the purpose of:

  • Amending ‘Schedule C – Additional Uses’ by inserting the use of ‘Restaurant/Café‘ as a discretionary use on No. 53 and 55 (Lots 31, 32 and 33) Canning Highway, Victoria Park.

The applicant has advised that the intent of this amendment relates to facilitating a ground floor Café to the ground floor “Communal Lounge” depicted in the Development Application for 23 Multiple Dwellings that was approved by the Metro Central Joint Development Assessment Panel (JDAP) in August 2019. A Café (which falls under the same land-use category as Restaurant under the Scheme) is currently a prohibited land use under the applicable zoning (Residential).

Discretionary land uses are not exempt from Development Approval. If this scheme amendment is initiated and subsequently adopted, a separate application and approval will be required.

The following Development Standards/Conditions are proposed to apply to this entry under Schedule C of the Scheme:

  1. Additional Use is restricted to the ground floor at the corner of Taylor Street and McCallum lane.
  2. Additional Use must address the street to the satisfaction of the Town.
  3. The maximum net lettable area of any Restaurant/Café uses shall be 120m2 in aggregate.
  4. The Additional Use of Restaurant/Café shall be deemed to be an “AA” use for the purposes of the Scheme.
  5. A development application for the Additional Uses is to be supported by technical reports assessing the parking demands of the use, and the extent of available nearby public parking.

In accordance with Local Planning Policy 37 “Community Consultation”, prior to Council resolving whether to initiate this Scheme Amendment, you are invited to provide comment.

Who will decide this application?

The final decision maker for this scheme amendment is the Minister for Planning.

Your written comments are welcome and will be considered by Council prior to a recommendation being made. This recommendation will be forwarded with the proposed scheme amendment documentation to the Western Australian Planning Commission. The Commission, in turn, will review the proposal and provide its recommendation to the Minister.
