BURSWOOD – No. 23 (Lot 86) The Circus – Proposed Change of Use from Restaurant to Unlisted Use (Small Bar)

Consultation has concluded

The Town has received a development application for proposed Change of Use from Restaurant to Unlisted Use (Small Bar).

In accordance with Local Planning Policy – Community Consultation on Planning Proposals, you are invited to comment on the following matters:

  • Proposed Use - The proposed development is for a proposed use which is not listed under Town Planning Scheme No. 1 and is therefore classified as an “Unlisted Use”.

The subject site falls within the Special Use area of the Town’s Town Planning Scheme No. 1 – Burswood Precinct. Under this precinct, a Small Bar is considered an “Unlisted Use”.

The applicant has advised that the application for the change of use solely relates to the Liquor Licensing requirements and does not propose to change the hours of operation and patronage numbers.

Racing, Gaming and Liquor advises that a restaurant licence under section 50 of the Act, authorises the sale and supply of liquor to persons on the licenced premises for consumption with a meal supplied by the licensee. In essence, the business should be focused on the regular supply of genuine meals. The supply of liquor should be secondary to this. I

Racing, Gaming and Liquor advises that a small bar licence authorises the sale and supply of liquor for consumption on the licenced premises only.
